Terms and Agreement

The following terms and conditions, along with the others set forth in the registration materials, govern the Student’s participation in the Japan Fuji Online courses. The Student’s participation in the JF Online Program is facilitated by KCP International U.S.A. Inc. and KCP International Japanese Language School.

DISCLOSURE OF ACADEMIC CHALLENGE. The Japan Fuji Online courses are challenging, intensive and demanding. Student should be aware of the high level of academic stress. Students should prepare to attend every live class session and spend ample time preparing and reviewing outside of these class sessions.

FULL AND COMPLETE RELEASE. Student releases Japan Fuji Online, KCP and its respective officers, board of directors, employees, volunteers and agents and any university that may transcribe (certify credit for) the coursework, from any and all claims and causes of action for damage to or loss of property, illness or injury, or death, arising out of Student’s participation in the Japan Fuji Online Program.

Student agrees to indemnify and hold harmless Japan Fuji Online, KCP, and university that may transcribe coursework if any, from any damage to property or injury to persons, including death, connected with the Japan Fuji Online Program, any Sponsor, or arising from Student’s acts or omissions. A Sponsor is the university, college or other institutional entity providing credit for the Japan Fuji Online Program.

Except for payment obligations, Japan Fuji Online or KCP is not responsible for or in default for delay or failure to perform any act required under this Agreement because of the occurrence of events beyond its reasonable control, including, but not limited to, internet disruptions, fires, floods, earthquakes, explosions, strikes, labor unrest, riots, serious accidents, acts of God, failures of or delays by common carriers or suppliers or vendors, government intervention, including without limitation epidemics, quarantine restrictions, third-party actions, or any cause if it is beyond Japan Fuji Online’s reasonable control. Any such event or cause is referred to herein as “Force Majeure” and any failure or delay resulting therefrom shall be deemed to be an “Excusable Delay or Failure.” If a Force Majeure event results in an Excusable Delay or Failure in Japan Fuji Online’s performance of any act to be performed by it under this Agreement, Japan Fuji Online shall promptly notify Student in writing of the cause of such Excusable Delay or Failure and of the steps Japan Fuji Online is taking to remedy such delay or failure of performance.

AUTHORIZATION TO RELEASE PERSONAL INFORMATION AND USE OF LIKENESS. Japan Fuji Online and KCP are authorized to share any information that is relevant to the health, registration, application for credits or academic success of the Student with the Student’s Sponsor.

Japan Fuji Online, KCP, and Sponsor sometimes use photographs or likenesses of Program participants in its catalogs and other publicity materials, written and electronic. Student authorizes Japan Fuji Online and KCP to use Student’s image for promotional purposes in all types and forms of media, whether written or electronic.

Student also agrees and understands that during class sessions both video and audio may be recorded. The primary purpose of such recordings is to give students who may have missed the class session another opportunity to view the lecture.

REFUND POLICY. Any request for withdrawal and refunds must be made in writing. A complete refund of all fees paid will be made if cancellation is made at least 7 days prior to the first day of class. A 50% refund of Japan Fuji Online’s Program fee will be made if written cancellations are made one week or less prior to the start of class. No refunds will be made after the first day of class. Student agrees and understands that failure to adhere to the payment schedule and billings sent by Japan Fuji Online may result in the rejection of Student’s application and a financial penalty may accrue.

NO WARRANTY. Student agrees and understands that the promotional and informational materials provided in connection with the Japan Fuji Online Program are for informational purposes only, and in no way a warranty of the content, results, or other aspects of the Program, or of the Program’s fitness for a particular student’s use. KCP International Japanese Language School and Japan Fuji Online reserve the right to make changes in the content and format of the Program without prior notice. KCP International U.S.A. Inc. is not responsible for the content or format of the coursework or course materials provided by Japan Fuji Online or KCP International Japanese Language School.

CREDIT AND FEES TO SPONSOR. Student agrees and understands that Japan Fuji Online does not guarantee that Student will obtain credit for the coursework. Student specifically releases Japan Fuji Online and KCP from any and all damage, loss or claim that may result from failure to obtain such credit. Student agrees and understands that the university that will transcript the courses, or a student’s home school, is responsible for the academic credit portion of this Program, and that their responsibility consists of granting academic credit for work satisfactorily completed during the Program in accordance with the rules and regulations of the Sponsor.

CONDUCT EXPECTATIONS. Student agrees and understands Student has behavioral responsibilities while participating in this Program, including attendance and participation in class. Student may be expelled from the Japan Fuji Online Program for any of the following reasons. No refunds of any kind will be allowed if a student’s program is cancelled for any of these reasons:

a. Any Student behavior, academic or other, which may interfere with other participants of the Program or the Program itself.
b. Excessive absenteeism without prior approval. More than three unexcused absences will result in cancellation.
c. Violation of this Agreement.
d. Failure to meet academic expectations/requirements of the Program. Students are expected to come to class prepared and ready to participate. Excessive non-preparedness will result in cancellation.
e. Failure to pay any fee or charge in a timely manner.

CANCELLATION. Japan Fuji Online reserves the right to decline any application or cancel any Japan Fuji Online Program without notice, in which event all moneys paid will be refunded in full.

WITHDRAWAL AND CANCELLATION. Japan Fuji Online reserves the right to decline admittance to a Student, cancel, suspend, or terminate the Program at any time and Japan Fuji Online’s sole responsibility shall be the return of any Program fees paid.

FINANCIAL RESPONSIBILITY. Student represents that Student is fully responsible for all fees and charges for the Program.

ONLINE ACCESS: Student is responsible for obtaining high speed internet access to the Program and for all computer hardware, software and other equipment necessary to do so.
